Terms of Service
WAYBURB TERMS OF SERVICE
Version 2
Last updated: 21 October 2026
1. Who we are and these Terms
WayBurb is operated by Jaxon Adrian Stone, an individual and sole trader trading as WayBurb, ABN 54 788 904 455, based in Queensland, Australia. “WayBurb”, “we”, “us” and “our” mean that operator.
These Terms apply to the WayBurb app, website and related services. They explain the agreement between you and WayBurb. Please read them before accepting. This version applies when you accept it. If you do not agree, do not continue using the services that require acceptance.
WayBurb is a map exploration and community app for discovering suburbs, recording progress, earning rewards and sharing place-related contributions. It is for personal recreation and general information. It is not a navigation, emergency or safety-critical service.
Our contact email is support@wayburb.com. Our website is https://wayburb.com.
2. Age and eligibility
You must be 18 or older to use WayBurb in Mexico and 16 or older elsewhere. Do not create or use an account below the applicable minimum age. Store content ratings do not change this account rule. We may ask you to confirm that you meet this requirement. Give an honest answer; do not use someone else’s identity to bypass it.
Outside Mexico, if you are 16 or 17, obtain a parent’s or guardian’s permission where required by the laws that apply to you. Permission does not waive the applicable minimum age or authorise a Mexico account for someone under 18.
We may restrict an account while reasonably investigating an age concern. If you are unable to meet the age requirement, you must stop using the app. You or your parent or guardian may contact us about account information, deletion and purchases. Not meeting the age requirement does not automatically remove applicable refund or consumer rights.
3. Your account
Provide accurate account information and keep your sign-in method secure. Do not share, sell or transfer your account or use another person’s account without authorisation.
You are responsible for your own use and for taking reasonable steps to protect your account. You are not automatically responsible for unauthorised activity you did not cause or reasonably could not prevent. Contact us promptly if you suspect unauthorised access.
Some features require a signed-in account, internet access, device permissions or a supported app version. Standard internet and mobile data charges may apply.
4. Safe and lawful exploration
Always pay attention to your surroundings. Do not operate WayBurb while driving or when doing so would distract you from safely operating a vehicle or equipment. Stop somewhere safe before interacting with the app.
A suburb boundary, discovery, suggested activity or map marker is not permission to enter a property or restricted area. Respect private property, access restrictions, road rules, warning signs and local laws. Do not trespass or place yourself or others at risk to obtain a discovery, reward, photo or leaderboard position.
Maps, boundaries, addresses, opening details and other place information can be wrong or out of date. Check important information independently. Do not rely on WayBurb for emergency assistance, safe routes, access rights or current conditions.
5. Discovery validation, offline use and fair play
Discoveries may depend on device location, accuracy, the relevant geographic boundary, timing, available Energy and other requirements shown in the app. Permission to access location does not guarantee a successful discovery.
Offline records are provisional until they are uploaded and validated. A queued or pending record does not guarantee credit. Records may be rejected, held for review or corrected where information is missing, duplicated, expired, inconsistent or fails the applicable validation rules. Keep the app’s displayed offline instructions and limits in mind.
Do not falsify location, spoof GPS, alter timestamps or discovery evidence, use automated tools to farm rewards, exploit errors, manipulate votes or leaderboards, or bypass discovery, purchase or moderation checks. Do not knowingly submit another person’s travel or content as your own.
We may investigate suspicious activity and correct inaccurate discoveries, rewards or statistics. We will base enforcement on reasonable grounds and provide a way to request review. A technical anomaly alone does not necessarily establish deliberate cheating.
6. Community rules and contributions
WayBurb may offer photos, ratings, comments, likes, profiles, friend features and other community contributions. Availability and contribution eligibility may vary by feature, including whether you have discovered the relevant suburb.
Only submit material that you own or have permission to share. Photos, ratings and comments should relate to the relevant place and reflect your own genuine experience. Do not misrepresent where a photo was taken or submit fabricated reviews.
Do not post or use WayBurb to share:
• harassment, threats, bullying, discriminatory abuse or targeted humiliation;
• sexual exploitation, sexual content involving minors, or material that endangers children;
• unlawful content, credible threats of violence or instructions encouraging serious harm;
• another person’s private information, precise home location or identifying details without a lawful basis;
• impersonation, scams, spam, deceptive promotions or manipulated engagement;
• content that infringes copyright, privacy or other rights; or
• malicious code or attempts to compromise accounts, systems or data.
Do not use photos, comments or other features to stalk people or monitor their movements. Obtain any permissions needed before uploading identifiable people or private-property imagery.
7. Ownership and permission to use your content
You keep ownership of the content you submit. You give WayBurb a non-exclusive, worldwide, royalty-free licence to host, store, copy, format, transmit and display that content as reasonably necessary to operate the features you use, make it available to the intended audience, moderate it and handle reports or disputes.
This licence permits our service providers to process content on our behalf for those purposes. It does not transfer ownership to us or give us an unrestricted right to sell your content or use private submissions in advertising.
When you delete content, the licence ends for its ordinary display after reasonable removal processing. Limited copies may remain where reasonably necessary for backups, security, legal obligations or resolving a dispute, as described in our Privacy Policy. Other people may retain copies they obtained outside our control.
If you believe content infringes your rights, contact support@wayburb.com with enough information to identify the content and explain your concern. Do not include passwords or unnecessary sensitive information.
8. Moderation, reporting and review
We may use automated systems, including AI-assisted checks, and human review to assess submissions, reports and suspicious activity. A submission may remain pending, be rejected, be removed after publication or require further review. Automated decisions can be mistaken.
We may limit contributions, remove content or restrict an account where reasonably necessary to address a breach, protect users, investigate abuse or comply with law. We will use measures proportionate to the concern. Where reasonably practicable, we will explain a restriction and how to ask for review, unless doing so would create a safety or security risk, compromise an investigation or be unlawful.
Use the reporting and blocking options available in the app, or email support@wayburb.com. You can request review of a moderation or discovery decision by explaining what happened and providing relevant information. We do not guarantee that every submission will be approved or restored.
9. Privacy and visibility
Our Privacy Policy explains how we handle personal information, including location, community submissions, moderation and purchase information. It is available in the app and at https://sites.google.com/view/wayburbprivacypolicy/home.
Read the audience and visibility information for the feature you use. Do not assume that an account or discovery-sharing setting also changes the audience of separately posted community photos, comments or ratings. Public content may be viewed or copied by others. A named suburb combined with a timestamp can reveal information about someone’s movements even without exact coordinates.
Accepting these Terms or acknowledging a Privacy Policy does not replace a separate permission or consent where one is required. Device location, photo access, notifications and advertising choices are managed through the controls available for those features and your device.
Requests for access, correction or deletion can be sent to support@wayburb.com. Our Privacy Policy explains the available procedures and retention practices.
10. XP, virtual items and conditional rewards
WayBurb may offer XP, levels, ranks, streaks, Energy, Pins, Star Shards, cosmetic items and other virtual rewards. These are app features, not money, deposits, investments or a promise of real-world value. They cannot be redeemed for cash or transferred outside the permitted app features, except where required by law.
Earned rewards may depend on completing and validating the stated requirements. We may correct duplicate, mistaken or fraudulently obtained awards. A technical error does not entitle someone to exploit it or retain an unearned benefit.
Some rewards are conditional rather than permanently owned. Golden Explorer currently depends on being in the global discovery top 10 on at least one of the 7-day, 30-day or all-time discovery leaderboards at the daily midnight Australia/Brisbane eligibility check. If you cease to qualify, access to the Golden Explorer set ends and equipped items from that set may be removed. You can regain access by meeting the requirements at a later check. Eligibility follows the official checked results, not an earlier screen display or the delivery of a notification.
Reward descriptions and purchase screens identify relevant conditions. We will not describe a temporary or conditional entitlement as permanent. Changes to paid benefits and purchased virtual items are subject to sections 11, 13 and 16 below.
11. Passport, subscriptions and purchases
WayBurb offers paid features and in-app purchases, which may include WayBurb Passport, Pins and other digital items. The purchase screen identifies the product, included benefits, price, billing period and any applicable offer conditions. Availability and prices may vary by platform or region. Pin packs are one-time purchases of the displayed quantities of Pins and included Star Shards; they do not renew. The checkout’s actual store currency and total, including applicable tax, govern the charge. Virtual Energy top-ups are separate purchases using Pins; build 86 limits these to three per Brisbane calendar day at the displayed Pin price. Hourly regeneration, the daily rewarded ad and an active unlimited-Energy benefit follow their own conditions. A shop reroll does not reset that daily purchase allowance.
A subscription renews according to the billing terms shown by the store unless cancelled before the applicable renewal deadline. The recurring amount, currency, billing period, charge date and any introductory/trial conditions must be made clear before you confirm. For Mexico, recurring charges require your express informed agreement, and automatic renewals are subject to the applicable advance-notice requirement of at least five calendar days. A receipt after a charge is not that advance notice. Do not rely on a push notification alone to manage cancellation. You retain the right to cancel future renewal without a WayBurb cancellation penalty and to ask us about a missing or incorrect notice. Any trial or introductory offer, its duration and the price after the offer must be shown when it is offered. Do not assume that a one-time item purchase cancels or replaces a subscription.
Purchases processed through Apple or Google are also subject to the relevant store’s payment and subscription terms. We may use purchase receipts and entitlement services to validate purchases and provide the correct account benefits. Use the relevant store account and available restore-purchase options when restoring supported purchases. Some consumable purchases are not restorable through the store’s standard restore function; contact us about missing purchases.
You can cancel an Apple subscription through Apple account subscription settings, or a Google Play subscription through Google Play subscription settings. Cancellation generally stops future renewal; the store’s terms and applicable law determine the effect on an already-paid period. The store cancellation controls can be opened immediately; do not wait for a support reply to use them. If you cannot reach them, contact us for prompt help. Apple: https://apps.apple.com/account/subscriptions. Google Play: https://play.google.com/store/account/subscriptions. WayBurb does not add a cancellation charge or require you to delete your account to cancel.
Signing out, declining updated policies, failing an age check, deleting the app or deleting a WayBurb account does not itself cancel an app-store subscription. Cancel it separately if you do not want it to renew.
12. Refunds, purchase problems and underage accounts
For an Apple-billed purchase, you can request a refund at https://reportaproblem.apple.com. For Google Play purchases, use Google Play’s refund process or contact us for assistance. Explain the actual circumstances of the purchase. Store refund approval is not automatic.
Contact support@wayburb.com about missing items, duplicate charges, paid features that do not work as described, or access restrictions affecting a purchase. Include the store, purchase date and relevant order or transaction reference. Do not send full payment-card details or account passwords.
If a person below the applicable minimum age has made purchases, that person or their parent or guardian can contact us and the relevant store about cancellation and refunds. We do not treat an age-check refusal as an automatic forfeiture of purchased balances or an automatic refund. We will consider the circumstances and applicable rights, and cooperate with appropriate purchase enquiries.
Nothing in these Terms creates a blanket “no refunds” rule or makes the app store solely responsible for obligations that the law places on WayBurb. Refunds, replacement, re-supply, cancellation or other remedies will be provided where required by applicable law. Valid purchase reversals or refunds may result in the corresponding entitlement being adjusted; corrections must relate to the affected purchase.
13. Consumer rights and our responsibility
You may have rights and remedies under the Australian Consumer Law or other mandatory consumer laws. These cannot be excluded, restricted or modified by these Terms. In Australia, relevant guarantees include that services are supplied with due care and skill. Remedies depend on the circumstances and the applicable law.
We will take reasonable care in providing WayBurb. We cannot promise uninterrupted availability, perfect map accuracy or that every technical problem can be prevented. We will take reasonable steps to investigate reported problems and provide any remedy required by law.
To the extent the law permits, neither party is responsible for losses that were not reasonably foreseeable when the relevant agreement was made. Nothing in these Terms excludes responsibility that cannot lawfully be excluded, or excuses fraud, wilful misconduct or a failure to meet non-excludable obligations. You do not indemnify us against our own wrongdoing merely by using WayBurb.
14. Ads, generated guides and external services
WayBurb may display advertising, including optional rewarded ads. The app explains any offered reward and the completion conditions. Ad availability and successful delivery can depend on provider availability and technical conditions. Contact us if you complete an offered requirement but do not receive the stated reward.
Some suburb descriptions, activities or other guide information may be AI-generated. It can contain mistakes or outdated information. Independently verify matters such as access, safety, opening times and suitability. A suggestion is not an endorsement or a guarantee that an activity is available.
WayBurb uses external services for functions such as maps, hosting, authentication, purchases, advertising and moderation. Those providers may have their own terms. Links to third-party content do not make that content ours. Our use of a provider does not remove our own legal responsibilities to you.
15. Intellectual property and permitted use
WayBurb’s software, branding, designs and content are owned by or licensed to us, except for user content and materials belonging to other rights holders. We permit you to use the app for its intended personal purposes while complying with these Terms.
Do not copy or commercially distribute protected app content, misuse our branding, remove required attribution, or access systems without authorisation. Restrictions on reverse engineering and similar activities apply only to the extent permitted by law. You retain any statutory rights to interoperability, research or other lawful uses that cannot be excluded.
16. Changes to features and these Terms
We may make reasonable changes to maintain, improve or secure WayBurb, comply with law, address abuse, or respond to changes in technology and providers. We will consider the effect on users and avoid unnecessary loss of paid benefits.
For a change that materially disadvantages users or removes a paid feature, we will give reasonable advance notice where practicable and explain available options. Urgent safety, security or legal changes may need to happen sooner. We will provide any cancellation right, refund or other remedy required by law, including where we cannot supply a paid service as agreed.
Updated Terms will identify their version and update date. Where we require acceptance of a material update, the app will ask you to review it before continuing. You may decline and stop using the affected services. A refusal is not a waiver of existing purchase, complaint or consumer rights, and a new version does not retrospectively remove accrued rights.
Changes to privacy practices are also subject to our Privacy Policy and any separate consent required by law. Publishing new wording alone does not authorise processing that otherwise requires consent.
17. Restriction, suspension and account closure
You may stop using WayBurb or request account deletion using the available in-app options or support@wayburb.com. Review subscription cancellation separately before leaving.
We may restrict or suspend access where we reasonably believe there is a material breach, an age-eligibility issue, fraud, a serious safety or security risk, or a legal requirement. We may close an account for serious or repeated breaches, where the issue cannot reasonably be resolved, or where continuing the service would be unlawful. Where appropriate and safe, we will give notice and an opportunity to address the issue or request review.
If WayBurb is discontinued, we will give reasonable notice where practicable and address outstanding paid entitlements and other obligations in accordance with applicable law.
Account closure does not automatically extinguish refund rights, complaints, payment obligations already lawfully incurred or other accrued rights. Data deletion and any necessary retention follow our Privacy Policy and applicable law. Completed deletion may make account progress and items unrecoverable.
18. Complaints and governing law
Please contact support@wayburb.com to raise a concern or request review. Explain the issue, relevant dates and the outcome you are seeking. We will consider complaints fairly and respond within a reasonable time. You do not have to give up the right to approach a regulator, consumer agency, tribunal or court. For Mexico, mandatory rights under the Ley Federal de Protección al Consumidor remain applicable where required, including remedies for non-conforming digital services and access to PROFECO (https://www.gob.mx/profeco). Spanish information and terms are available for Mexican consumers; if a translation differs, it does not reduce mandatory local rights. No clause requires a Mexican consumer to waive applicable local protections or complain only in Australia.
These Terms are governed by the laws of Queensland, Australia, except to the extent mandatory laws elsewhere apply to you. Nothing here requires you to bring a consumer claim only in Queensland or removes a right to use a court or tribunal available under applicable law.
If a provision is unenforceable, the remaining provisions continue only to the extent lawful and workable. A delay in enforcing a right is not automatically a waiver of it. These Terms do not override specific purchase commitments or mandatory rights.
